I\/ GENERAL PROVISIONS (BASIC DATA)<\/strong>
Please carefully read these General terms and conditions of eCommerce of Di \u010cazma d.o.o., Alojza Vulinca 28, \u010cazma (City of \u010cazma), OIB: 48193612203, telephone number: +385 (0)43 772 320, e-mail:\u00a0info.dic@floriangroup.hr<\/a>\u00a0(hereinafter: “General terms”) before using the website www.woodandwise.com for the purpose of purchasing Products advertised on it, conclusion of a share purchase contract or obtainment of information on a particular Product.<\/p>

These General terms regulate the use of Web site and are applicable to the share purchase contract of the Product concluded between the Customer and the Seller remotely through the means of distance communication. Therefore, it is considered that Users are at each moment fully familiar with these General terms and that they fully understand and accept them.<\/p>

Please note that all of the provisions of these General terms shall apply to legal persons, except:
1. the right to unilateral termination of the Contract;<\/p>

2. consumers right regarding material defects;<\/p>

3. resolving disputes before and outside the court;<\/p>

4. exclusion under this General terms;<\/p>

5. in case of the agreement concluded with the particular legal person, in which case the provisions of such agreement shall apply, unless otherwise defined under this agreement.<\/p>

On the above issues regarding legal persons, with the exception of item 3\/ of the previous paragraph, the provisions of Obligatory Act and other applicable regulations shall apply, namely the provisions of the agreement, unless otherwise stipulated under the agreement.<\/p>

Interpretation of individual terms listed in these General terms (words in singular include the plural and vice versa, unless the context indicates otherwise):<\/p>

\u2022 Seller: means the company Di \u010cazma d.o.o., with registered seat in \u010cazma (City of \u010cazma), Alojza Vulinca 28, registered with the Commercial court in Bjelovar under registration number (MBS): 010045623,, EUID HRSR.010045623 OIB: 48193612203, e-mail:\u00a0customercare@woodandwise.com<\/a><\/p>

\u2022 Website: means the website www.woodandwise.com owned by the Seller;<\/p>

\u2022 Customer: means legal and natural person \u2013 consumer (person of legal age and legal capacity who enters into a legal transaction on the market for purposes that are not intended for her occupation or her business activity or entrepreneurial activity) with residence, namely registered seat in United Kingdom, Germany, or Italy who orders at least one Product offered on the Website;<\/p>

\u2022 Site visitor: is a person who accesses the Website through means of electronic communication and freely browses the featured Product offer<\/p>

\u2022 Users means the Customer and Site visitor together;<\/p>

\u2022 Online store: means the Product’s Online store available on the Seller’s Website;<\/p>

\u2022 Product: means any product that is featured on the Website and that can be purchased via the Online store;<\/p>

\u2022 “Contract” means contract for the sale and purchase of the Products concluded between the Seller and the Customer concluded using the means of distance communication, incorporating, or deemed to incorporate these General terms.<\/p>

II\/ VALIDITY OF THE GENERAL TERMS<\/strong>
The Seller reserves the right to amend these General terms at any time, subject to publication on the Website.<\/p>

Access to the Website may sometimes be unavailable due to work, maintenance, or due to introduction of new content, and in cases of unforeseen circumstances that are beyond the control of the Seller, which the Seller shall try to rectify as soon as possible.<\/p>

In the event that any issue is not regulated by these General terms of the Seller, the provisions of the current Consumer Protection Act, Civil Obligations Act, Electronic Commerce Act and other applicable regulations shall apply.<\/p>

III\/ PRODUCT OFFER<\/strong>
The Product offer with description of the same is available on the Seller’s Website. The subject of the order can only be those Products for which it is indicated in the order that they are available and accessible.<\/p>

In the event that the ordered Product is not available in the warehouse, the Seller shall inform the Customer that the Product is not currently available, the time frame in which the Product shall be available, agree on a new delivery date if necessary, and at the same time offer the possibility of purchasing an alternative Product that is available for delivery and which characteristics are closest to the Product that cannot be delivered. In the event that it is not possible to deliver the purchased and ordered Product, the Seller shall refund all paid funds to the Customer without delay.<\/p>

Product images on the Website are symbolic in nature and there is a possibility of deviations from the actual Product (including but not limited to dimensions and colour shades), which do not affect the specification of the Product itself, and the Seller is not responsible for such deviations. The Customer has no right to complain about the Product on the basis mentioned.<\/p>

IV\/ CONCLUSION OF THE CONTRACT<\/strong>
Contract between the Seller and the Customer is concluded at the moment when the Customer submits the order, i.e. by clicking on the label “Submit order\/Order with obligation to pay”. From that moment, prices and other purchase conditions are fixed and binding for both parties, unless otherwise stated in these General terms.<\/p>

V\/ INSTRUCTIONS FOR BUYING THROUGH THE INTERNET SHOP<\/strong>
The purchase of the Product can be made by a registered or unregistered User. In case of registration, by filling out the form, the User confirms the accuracy and completeness of the specified personal data in the online form and confirms that he is fully aware of and accepts these General terms. In the event that the User orders the Product without prior registration, before placing the order, he confirms by clicking on the appropriate field that he is fully aware of and accepts these General terms.<\/p>

Ordering Products via the Internet store is done in German, English, Italian and French on the Seller’s Website 24 hours a day and 7 days a week (except for the case of regular maintenance of the Website, in which case the same is not available).<\/p>

The shopping instructions are as follows:<\/p>

1. Before submitting the order, the Customer can review the entire content of the order and correct any errors. On the Website, the Seller shall, at the latest at the beginning of the ordering process, clearly and legibly indicate whether any restrictions apply in terms of delivery, and which means of payment are accepted.<\/p>

2. By submitting the order, the Customer expressly confirms his obligation to pay. The Customer submits the order by clicking on the label “Submit order\/Order with obligation to pay”, at which point the Contract between the Seller and the Customer is considered concluded.<\/p>

3. After receiving the order in the information system, the Seller reviews the order and, no later than 8 working days after receiving the order, informs the Customer by e-mail on the expected delivery date and other information regarding the delivery of the Product. The Seller may call the Customer on his contact phone number to check the data or to ensure the accuracy of the delivery. If the delivery time is very long and the Customer does not want to wait, he can inform the Seller about the same in writing within 3 days from the day of receiving the e-mail about the expected delivery time, in which case the Seller shall remove the Product in question from the order and return to the Customer any possibly paid funds, and deliver the rest of the Products from the order at the Customer’s choice or cancel the order in its entirety.<\/p>

4. The Seller prepares and sends the Product by the carrier of his own choose within the agreed period and informs the Customer about this by e-mail.<\/p>

The procedure for purchasing the Product via Online store by Costumer legal persons is identical as for the Customer consumers- natural person, provided that the legal person, during the registration or ordering of the Product, chooses the option \u201cI am legal person\u201d and enters the tax number (VAT number) of the company.<\/p>

VI\/ PRICES OF THE PRODUCTS<\/strong>
Product prices are retail prices expressed in euros.<\/p>

All prices include VAT, unless expressly stated otherwise.<\/p>

Delivery costs are included in the Product prices for the following Countries: Italy (no islands), Germany, Austria, Belgium, Denmark, Luxembourg, Netherlands, Switzerland, France, Spain, Croatia, Poland, Czech Republic, Slovenia, Hungary, Romania, and Bosnia and Herzegovina, except in the case of orders below a certain amount, under the conditions specified in these General terms. Deliveries in the rest of the European Union countries and in the rest of the world, if agreed, are not included in the Product prices.<\/p>

Before confirming the order, the price of the Product, the cost of delivery (if any), the price of VAT, and the total price are shown separately so that the Customer has an overview of the final price he pays for the ordered purchase service. In case of payment by e-banking and payment slip, payment costs and\/or interbank transactions are not included in the price.<\/p>

VII\/ PAYMENT<\/strong>
When purchasing in the Online store, the Customer pays via VISA, MASTERCARD, AMEX, Paypal and bank transfer.<\/p>

For payment by credit card, payment is made immediately after order confirmation and before delivery of the ordered Product.<\/p>

If the card transaction is approved, the amount will be reserved immediately, and you will receive a purchase confirmation to your e-mail.<\/p>

If the card transaction is not approved your order will be cancelled.<\/p>

Security of Online Payments<\/strong><\/p>

While conducting payments on our web shop you are using CorvusPay \u2013 an advanced system for secure acceptance of credit cards on the Internet.
CorvusPay system ensures complete privacy of your credit card data and personal data from the moment you type them into the CorvusPay payment form. Data required for billing is
forwarded encrypted from your web browser to the bank that issued your payment card. Our store never comes into contact with your sensitive payment card data. Similarly, CorvusPay
operators cannot access your complete cardholder data. An isolated system core independently transmits and manages sensitive data while at the same time keeping it completely safe.
The form for entering payment data is secured by an SSL transmission cipher of the greatest reliability. All stored data is additionally protected by hi-grade encryption, using hardware

Conversion statement:<\/strong> All payments will be effected in Croatian currency. The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.<\/p>

VIII\/ PURCHASE CONFIRMATION<\/strong>
If the Customer purchased the Product thorough Online store, the Seller shall send to the Customer a written confirmation of the completed transaction. The confirmation shall be issued on a paper or on a permanent medium such as an e-mail message or a message on a personal account on the Seller’s Website, provided that the same is in a form that the Customer can save, and that the Seller cannot change without the Customer’s approval.<\/p>

IX\/ DELIVERY OF PRODUCTS<\/strong>
The Seller undertakes to deliver purchased Product to the Customer’s address specified during registration or ordering.<\/p>

The Seller offers delivery of the Product exclusively on the territory of Italy (no islands), Germany, Austria, Belgium, Denmark, Luxembourg, Netherlands, Switzerland, France, Spain, Croatia, Poland, Czech Republic, Slovenia, Hungary, Romania, and , Bosnia and Herzegovina. For deliveries in the rest of the European Union countries and in the rest of the world you have to contact the Seller.<\/p>

The Seller reserves the right to choose a contractual courier service or mail service based on his own judgment. The risk of damage to the Product or its failure passes to the Customer at the time of delivery of the parcel to the Customer.<\/p>

The deadline for the delivery of the Product is 40-45 days from the date of receipt of the order within the time limit and in the manner specified in these General terms.<\/p>

The above delivery dates do not apply to locations that do not support daily delivery.<\/p>

In the case it is not possible to deliver ordered Product or postponement of the delivery date, the Seller shall inform the Customer as soon as possible on e-mail or telephone on the problems that have arisen, and a new delivery date shall be agreed, or the amount paid by the Customer shall be returned in total. The Customer certifies each shipment and signs the receipt of the shipment. With the signature of the receipt by the Customer, it is considered that the shipment was delivered, therefore the Seller shall not be liable for any later liabilities on such basis.<\/p>

X\/ DELIVERY COSTS<\/strong>
The Customer shall be informed on the cost of delivery when ordering each individual Product, namely on the total cost of delivery in case of ordering several Products.<\/p>

Shipping costs are free of charge for all orders above EUR\u20ac 2,000.00, as well as for promotional Products with indicated free shipping. Delivery costs for orders under EUR\u20ac 2,000.00 must be agreed with the Seller.<\/p>

In case it is not possible to duly deliver the Product to the address indicated by the Customer, the Customer shall bear the costs of re-delivery.<\/p>

The Seller does not have any additional costs for means of remote communication.<\/p>

XI\/ INVOICE<\/strong>
After delivery of purchased Products, the Seller shall send to the Customer an invoice in pdf format to the Customer’s e-mail address. By agreeing to these General terms, the Customer gives his express consent for the invoice to be issued in electronic form.<\/p>

The Customer has the right to submit a complaint about the invoice via e-mail\u00a0customercare@woodandwise.com<\/a>\u00a0of the Seller. The Seller is obliged to respond in writing to the customer’s complaint by e-mail within 15 days from the day of receiving it.<\/p>

The Seller keeps an electronic copy of the invoice in its database for as long as it is prescribed by the applicable regulations.<\/p>

XII\/ CUSTOMER’S RIGHT TO UNILATERAL TERMINATION OF THE CONTRACT<\/strong><\/p>

The Customer has the right to unilaterally terminate the Contract within 14 days as of the day of receipt of the Product, without the need to state the reason for his decision and without penalty.<\/p>

Notice on termination and the form for unilateral termination of the Contract, are available on the Web site at the link\u00a0www.woodandwise.com<\/a><\/p>

XIII\/ GUARANTEE<\/strong>
For the Product from the Seller’s offer that is advertised on the Website, and with which it is indicated that there is a guarantee for the correctness of the purchased Product, the warranty shall be delivered to the Customer certified with the purchased Product for the duration indicated under the warranty.<\/p>

Information on the authorized services of the purchased Product can be found in the warranty.<\/p>

When the Customer exercises his rights from the warranty, which must be in accordance with the warranty, the same may submit a complaint to the Seller at the e-mail address\u00a0customercare@woodandwise.com<\/a><\/p>

The return of the Product is carried out in accordance with the conditions specified under the warranty.<\/p>

XIV\/ MATERIAL DEFECTS AND NOTICE ON HOW TO SUBMIT A WRITTEN COMPLAINT<\/strong><\/p>

In case that the Customer considers that the purchased Product has material defects, namely in case the Customer has complaints, the same may submit a written objection or complaint to the e-mail address\u00a0customercare@woodandwise.com<\/a>\u00a0with the indication “Complaint” stating the order number, account number or his username. The Seller shall confirm the receipt of the written objection or complaint to the Customer without delay.<\/p>

The Seller shall respond to the Customer on the merits of his request within 15 days as of the day of receipt of the written complaint.<\/p>

While submitting the complaint, the following must be attached:
\u2022 Product invoice;
\u2022 Photos of the entire damaged Product;
\u2022 Photos of damage details (from multiple angles);
\u2022 Photos of the Product’s serial number (if any).<\/p>

The Seller is responsible for material defects on the Product at the moment of risk transfer on the Customer.<\/p>

Inspection of the Product by the Customer- consumer
The Customer-consumer shall inform the Seller on the existence of visible defects on the Product within two months as of the day he discovered the defect, and no later than two years from the transfer of risk to the Customer and allow him to inspect the Product. In the event of a hidden defect, the Customer is obliged, under threat of loss of rights, to inform the Seller on defect within two months as of the day he discovered the defect. In any case, the Seller is not liable for defects that appear after two years as of the delivery of the Product.<\/p>

Inspection of the Product by the Customer- legal person
The Customer-legal person shall inspect the delivered Product in a customary manner or have the Product inspected, as soon as possible in the regularly course of events, and notify the Seller of visible defects within
the period of eight days, or in respect of a commercial contract without delay, otherwise he shall lose the right entitled to him in this regard<\/p>

Where after the Customer receives a Product becomes apparent that the Product has a defect that could not have been discovered by usual inspection when the delivery was taken, the Customer shall, under threat of losing the right, notify the Seller thereof within the period of two months, not including the day when the defect was discovered, or without delay in respect of a commercial contract.<\/p>

The Seller is not responsible for defects of delivered Product due to improper handling by the Customer (consumer or legal person) or a third party, including defects caused by incorrect installation or assembly.<\/p>

In case the Customer’s claim is founded, the Seller shall replace or repair the Product at its own cost within the same period of time in which it was delivered. In case that replacement or repair of the Product is not possible due to objective reasons or is associated with disproportionate costs, the Customer has the right to a price reduction or termination of the Contract.<\/p>

In case the complaint is not founded (e.g. improper maintenance of the Product, and similar), and the Customer’s complaint is rejected as unfounded, the Customer shall bear the cost of returning the Product due to the complaint and the cost of re-delivery of the purchased Product to his address.<\/p>

On all issues related to material defects not regulated under these General terms, the relevant provisions of the Obligatory Act and Law on consumer protection shall apply.<\/p>

XV\/ PROTECTION AND SECURITY<\/strong>
The Seller uses appropriate technological and organizational means to protect the transfer and storage of personal data and payments through Internet sales.<\/p>

The Seller undertakes to take all reasonable security measures to ensure the protection of all data for the payment of the Customer’s order. The Seller shall not be responsible for potential data theft, except in cases prescribed by law.<\/p>

The Seller receives data related to the Customer’s order. If the Customer does not provide the requested information, this may affect the correct execution of his order.<\/p>

XVI\/ PRIVACY POLICY AND COOKIES<\/strong>
The Privacy Policy and Cookie Policy of the Seller are available on the Website on links\u00a0www.woodandwise.com\/privacy<\/u><\/a>\u00a0and\u00a0 \u00a0www.woodandwise.com\/cookiepolicy<\/u><\/a><\/p>

The User is responsible for the protection of personal data by providing an e-mail address, username, and password, as well as the appropriate software (antivirus) protection for his computer.<\/p>

XVII\/ RESOLUTION OF DISPUTES<\/strong>
The Seller and the Customer undertake to resolve all disputes arising in connection or under these General terms or Contract amicably.<\/p>

In the event that no amicable solution is possible, namely in case the Seller does not accept the complaint of the Customer, the same shall inform the Customer on reasons for rejection of the complaint and advise the same on possibilities of dispute resolution in accordance with the following paragraph.<\/p>

In case the Customer-consumer is not satisfied with the decision of the Seller on complaint, the same may in regard to dispute settlement:
\u2022 visit the online dispute resolution (ODR) platform on https:\/\/webgate.ec.europa.eu\/odr\/main\/index.cfm?event=main.home.show&lng=HR<\/u><\/a>;
\u2022 bring proceeding against the Seller either in the courts of the Member State in which the Seller has registered seat, or, regardless of the registered seat of the Seller, in the courts for the place where the Customer- consumer is domiciled.<\/p>

In case of a dispute with the Customer-legal person, Buyer and Seller mutually agree that on this General terms and Contract and their interpretation the laws of the Republic of Croatia shall apply, and that all disputes shall be settled before the competent court of the registered seat of the Seller.<\/p>

Ovi Op\u0107i uvjeti primjenjuju se na kori\u0161tenje Web stranice te na ugovor o kupoprodaji Proizvoda sklopljen na daljinu putem sredstava daljinske komunikacije izme\u0111u Kupca i Prodavatelja te \u010dine sastavni dio istog, pri \u010demu se smatra da su Korisnici u svakom trenutku u cijelosti upoznati s ovim Op\u0107im uvjetima te da iste u potpunosti razumiju i prihva\u0107aju.<\/p>

Napominjemo kako za pravne osobe vrijede sve odredbe ovih Op\u0107ih uvjeta, osim:
1. prava na jednostrani raskid Ugovora;<\/p>

2. prava potro\u0161a\u010da u vezi s materijalnim nedostacima;<\/p>

3. postupka izvansudskog i sudskog rje\u0161avanja potro\u0161a\u010dkih sporova;<\/p>

4. ukoliko je isklju\u010dena primjena ovim Op\u0107im uvjetima;<\/p>

5. u slu\u010daju ugovora sklopljenog sa pojedinom pravnom osobom, u kojem slu\u010daju se primjenjuju odredbe tog ugovora, osim ukoliko tim ugovorom nije druga\u010dije odre\u0111eno.<\/p>

Na naprijed navedena pitanja glede pravnih osoba, izuzev to\u010dke 3\/ prethodnog stavka, primjenjuju se odredbe va\u017ee\u0107eg Zakona o obveznim odnosima, te ostalih primjenjivih propisa, odnosno ugovora sklopljenog sa pojedinom pravnom osobom.<\/p>

\u2022 Kupac: zna\u010di pravna i fizi\u010dka osoba – potro\u0161a\u010d (punoljetna i poslovno sposobna osoba koja sklapa pravni posao na tr\u017ei\u0161tu u svrhe koje nisu namijenjene njezinu zanimanju niti njezinoj poslovnoj aktivnosti ili poduzetni\u010dkoj djelatnosti) sa prebivali\u0161tem odnosno sjedi\u0161tem u zemljama Velike Britanije, Njema\u010dke ili Italije koja naru\u010di barem jedan Proizvod ponu\u0111en na Web stranici;<\/p>

\u2022 Posjetitelj stranica: je osoba koja putem sredstava elektroni\u010dke komunikacije pristupi na Web stranicu te slobodno razgledava istaknutu ponudu Proizvoda;<\/p>

\u2022 Internetska trgovina: zna\u010di Internetska trgovina Proizvoda dostupna na Web stranici Prodavatelja;<\/p>

\u2022 Proizvod: zna\u010di svaki proizvod koji je istaknuti na Web stranici, a koje je mogu\u0107e kupiti putem Internetske trgovine.<\/p>

\u2022 Ugovor: zna\u010di ugovor o kupoprodaji Proizvoda sklopljen izme\u0111u Prodavatelja i Kupca na daljinu putem sredstava daljinske komunikacije te kojeg sastavni dio \u010dine odredbe ovih Op\u0107ih uvjeta.<\/p>

II\/ VALJANOST OP\u0106IH UVJETA<\/strong>
Prodavatelj zadr\u017eava pravo na izmjenu ovih Op\u0107ih uvjeta u bilo kojem trenutku, a pod uvjetom objave na Web stranici.<\/p>

Pristup na Web stranicu ponekad mo\u017ee biti nedostupan zbog radova, odr\u017eavanja ili uvo\u0111enja novih sadr\u017eaja, te u slu\u010dajevima nepredvi\u0111enih okolnosti koje su izvan kontrole Prodavatelja, a koje \u0107e Prodavatelj nastojati otkloniti u najkra\u0107em mogu\u0107em roku.<\/p>

U slu\u010daju da bilo koje pitanje nije ure\u0111eno ovim Op\u0107im uvjetima Prodavatelja, na isto se primjenjuju odredbe va\u017ee\u0107eg Zakona o za\u0161titi potro\u0161a\u010da; Zakona o obveznim odnosima; Zakona o elektroni\u010dkoj trgovini te drugih primjenjivih propisa.<\/p>

III\/ PONUDA PROIZVODA<\/strong>
Ponuda Proizvoda sa opisom istih nalazi se na Web stranici Prodavatelja. Predmet narud\u017ebe mogu biti samo oni Proizvodi za koje je u narud\u017ebi nazna\u010deno da su raspolo\u017eivi i dostupni.<\/p>

U slu\u010daju da naru\u010deni Proizvod nije raspolo\u017eiv na skladi\u0161tu, Prodavatelj \u0107e obavijestiti Kupca da Proizvod trenutno nije raspolo\u017eiv, roku u kojem je proizvod raspolo\u017eiv, dogovoriti novi rok isporuke po potrebi, te ujedno ponuditi mogu\u0107nost kupnje alternativnog Proizvoda koji je raspolo\u017eiv za isporuku i koji je po svojim karakteristikama najbli\u017ei Proizvodu koji nije mogu\u0107e isporu\u010diti. U slu\u010daju da nije mogu\u0107e isporu\u010diti kupljeni i naru\u010deni Proizvod, Prodavatelj \u0107e bez odgode izvr\u0161iti povrat svih upla\u0107enih sredstava Kupcu.<\/p>

Slike Proizvoda na Web stranici su simboli\u010dne prirode te postoji mogu\u0107nost odstupanja iste od stvarnog Proizvoda (uklju\u010duju\u0107i, ali ne ograni\u010davaju\u0107i se na dimenzije i nijanse boja), a \u0161to ne utje\u010du na specifikaciju samog Proizvoda te Prodavatelj nije odgovoran za takva odstupanja. Kupac nema pravo reklamacije Proizvoda sa navedene osnove.<\/p>

IV\/ SKLAPANJE UGOVORA<\/strong>
Ugovor izme\u0111u Prodavatelja i Kupca zaklju\u010duje se u trenutku kada Kupac preda narud\u017ebu, odnosno klikom na oznaku \u201ePredaj narud\u017ebu\/Narud\u017eba s obvezom pla\u0107anja\u201c. Od tog trenutka cijene i drugi uvjeti kupnje su fiksni i obvezuju\u0107i za obje strane, osim ukoliko nije druga\u010dije navedeno ovim Op\u0107im uvjetima.<\/p>

V\/ UPUTE ZA KUPNJU PUTEM INTERNET TRGOVINE<\/strong>
Kupnju Proizvoda mo\u017ee izvr\u0161iti registrirani ili neregistrirani Korisnik. U slu\u010daju registracije, Korisnik popunjavanjem obrasca potvr\u0111uje to\u010dnost i potpunost navedenih osobnih podataka u online obrascu te potvr\u0111uje da je u cijelosti upoznat te prihva\u0107a ove Op\u0107e uvjete. U slu\u010daju da Korisnik naru\u010duje Proizvod bez prethodne registracije, prije narud\u017ebe isti potvr\u0111uje klikom na odgovaraju\u0107e polje da je u cijelosti upoznat te prihva\u0107a ove Op\u0107e uvjete.<\/p>

Naru\u010divanje Proizvoda putem Internet trgovine obavlja se na njema\u010dkom, engleskom, talijanskom te francuskom jeziku na Web stranici Prodavatelja 24 sata na dan i 7 dana u tjednu (izuzev slu\u010daja redovnog odr\u017eavanja Web stranice u kojem slu\u010daju ista nije dostupna).<\/p>

Upute za kupnju su sljede\u0107e:<\/p>

1. Prije predaje narud\u017ebe Kupac ima priliku pregledati cjelokupni sadr\u017eaj narud\u017ebe i ispraviti eventualne pogre\u0161ke. Na Web stranici Prodavatelj \u0107e, najkasnije na po\u010detku postupka naru\u010divanja, jasno i \u010ditljivo navesti primjenjuju li se u pogledu isporuke ikakva ograni\u010denja i koja se sredstva pla\u0107anja prihva\u0107aju.<\/p>

2. Predajom narud\u017ebe Kupac izri\u010dito potvr\u0111uje svoju obvezu pla\u0107anja. Kupac predaje narud\u017ebu klikom na oznaku \u201ePredaj narud\u017ebu\/Narud\u017eba s obvezom pla\u0107anja\u201c u kojem trenutku se smatra da je Ugovor izme\u0111u Prodavatelja i Kupca zaklju\u010den.<\/p>

3. Nakon primitka narud\u017ebe u informacijski sustav Prodavatelj pregledava narud\u017ebu te najkasnije u roku od 8 radnih dana od dana primitka narud\u017ebe obavje\u0161tava Kupca e-mail o predvi\u0111enom roku isporuke i drugim informacijama u vezi isporuke Proizvoda. Prodavatelj mo\u017ee nazvati Kupca na njegov kontakt-broj telefona radi provjere podataka ili kako bi se osigurala to\u010dnost isporuke. Ako je rok isporuke vrlo dug i Kupac ne \u017eeli \u010dekati, o istome mo\u017ee obavijestiti Prodavatelja pisanim putem u roku od 3 dana od dana zaprimanja e-po\u0161te o predvi\u0111enom roku isporuke, u kojem slu\u010daju \u0107e Prodavatelj ukloniti iz narud\u017ebe predmetni Proizvod i Kupcu vratiti ve\u0107 eventualno upla\u0107ena sredstva, a ostale Proizvode iz narud\u017ebe po izboru Kupca isporu\u010diti ili narud\u017ebu u cijelosti stornirati.<\/p>

4. Prodavatelj u dogovorenom roku Proizvod priprema i \u0161alje putem dostavlja\u010da po svom izboru te o tome e-po\u0161tom obavje\u0161tava Kupca.<\/p>

Postupak kupnje Proizvoda putem Internetske trgovine za Kupce pravne osobe isti je kao i za Kupce potro\u0161a\u010de-fizi\u010dke osobe, s time da pravna osoba tijekom registracije ili prilikom naru\u010divanja Proizvoda odabire opciju \u201eja sam pravna osoba\u201c te upisuje porezni broj (PDV identifikacijski broj) dru\u0161tva.<\/p>

VI\/ CIJENE PROIZVODA<\/strong>
Cijene Proizvoda su maloprodajne cijene izra\u017eene u eurima i kunama do dana 31. prosinca 2023. godine, a poslije samo u eurima.<\/p>

Sve cijene uklju\u010duju PDV, osim ako nije izri\u010dito navedeno druga\u010dije.<\/p>

Tro\u0161kovi dostave su uklju\u010deni u cijene Proizvoda za dostave u Italiju (izuzev otoka), Njema\u010dku, Austriju, Belgiju, Dansku, Luksemburg, Nizozemsku, \u0160vicarsku, Francusku, \u0160panjolsku, Hrvatsku, Poljsku, \u010ce\u0161ku Republiku, Sloveniju, Ma\u0111arsku, Rumunjsku te Bosnu i Hercegovinu, osim u slu\u010daju narud\u017ebe ispod odre\u0111enog iznosa, pod uvjetima odre\u0111enim ovim Op\u0107im uvjetima. Dostave u ostale dr\u017eave \u010dlanice Europske Unije te ostale dr\u017eave svijeta, ukoliko su ugovorene, nisu uklju\u010dene u cijene Proizvoda.<\/p>

Prije potvrde narud\u017ebe odvojeno je iskazana cijena Proizvoda, tro\u0161ak dostave (ukoliko isti postoji), cijena PDV-a, te sveukupna cijena kako bi Kupac imao uvid u kona\u010dnu cijenu koju pla\u0107a za naru\u010denu uslugu kupnje. U slu\u010daju pla\u0107anja e-bankingom i op\u0107om uplatnicom, tro\u0161kovi uplate i\/ili me\u0111ubankarske transakcije nisu uklju\u010deni u cijenu.<\/p>

VII\/ PLA\u0106ANJE<\/b>
Prilikom kupnje u Internetskoj trgovini Kupac pla\u0107a putem VISA, MASTERCARD, AMEX, Paypal-a i bankovnim transferom.<\/p>

Za pla\u0107anje kreditnom karticom pla\u0107anje se vr\u0161i odmah nakon potvrde narud\u017ebe i prije isporuke naru\u010denog Proizvoda.<\/p>

Ukoliko je karti\u010dna transakcija odobrena, iznos \u0107e biti odmah rezerviran, a na Va\u0161 e-mail dobiti \u0107ete potvrdu kupnje.<\/p>

Ukoliko karti\u010dna transakcija nije odobrena, Va\u0161a narud\u017eba biti \u0107e otkazana.<\/b><\/p>

Sigurnost online pla\u0107anja<\/strong><\/p>

Prilikom pla\u0107anja na na\u0161em web shopu koristite CorvusPay \u2013 napredni sustav za siguran prihvat kreditnih kartica na Internetu.
CorvusPay sustav osigurava potpunu privatnost podataka Va\u0161e kreditne kartice i osobnih podataka od trenutka kada ih upi\u0161ete u CorvusPay obrazac za pla\u0107anje. Podaci potrebni za naplatu su
proslije\u0111en kriptirano iz va\u0161eg web preglednika banci koja je izdala va\u0161u platnu karticu. Na\u0161a trgovina nikada ne dolazi u kontakt s va\u0161im osjetljivim podacima o platnoj kartici. Sli\u010dno, CorvusPay
operateri ne mogu pristupiti va\u0161im potpunim podacima o vlasniku kartice. Izolirana jezgra sustava neovisno prenosi i upravlja osjetljivim podacima dok ih u isto vrijeme dr\u017ei potpuno sigurnima.
Obrazac za unos podataka o pla\u0107anju osiguran je SSL prijenosnom \u0161ifrom najve\u0107e pouzdanosti. Svi pohranjeni podaci dodatno su hardverski za\u0161ti\u0107eni visokokvalitetnom enkripcijom
ure\u0111aji certificirani prema standardu FIPS 140 2 Level 3. CorvusPay ispunjava sve zahtjeve za sigurno online pla\u0107anje koje propisuju vode\u0107i brendovi kreditnih kartica, djeluju\u0107i u skladu sa
standard PCI DSS Level 1 – najvi\u0161i sigurnosni standard u industriji platnih kartica. Pla\u0107anja izvr\u0161ena karticama uklju\u010denim u program 3-D Secure dodatno se autentificiraju od strane
banka izdavatelj, potvr\u0111uju\u0107i va\u0161 identitet upotrebom tokena ili lozinke. Sve informacije koje prikuplja Corvus Pay smatraju se tajnom i s njima se postupa u skladu s tim. Informacija je
koristiti isklju\u010divo u svrhe za koje su namijenjeni. Va\u0161i osjetljivi podaci potpuno su sigurni, a njihovu privatnost jam\u010de najsuvremeniji za\u0161titni mehanizmi. Sakupljamo samo
podatke potrebne za obavljanje posla u skladu sa zahtjevnim propisanim procedurama za online pla\u0107anje. Sigurnosne kontrole i operativni postupci koji se primjenjuju unutar
CorvusPay infrastruktura ne samo da osigurava trenutnu pouzdanost CorvusPay-a, ve\u0107 trajno odr\u017eava i pobolj\u0161ava sigurnosne razine za\u0161tite podataka va\u0161e kreditne kartice odr\u017eavanjem
stroge kontrole pristupa, redovite sigurnosne i dubinske provjere sustava za sprje\u010davanje ranjivosti mre\u017ee<\/p>

Izjava o konverziji<\/strong>: Sva pla\u0107anja bit \u0107e izvr\u0161ena u hrvatskoj valuti. Napla\u0107eni iznos na ra\u010dunu va\u0161e kreditne kartice prera\u010dunava se u va\u0161u lokalnu valutu prema te\u010daju karti\u010dnih udruga.<\/p>

VIII\/ POTVRDA O KUPNJI<\/b>
Ukoliko Kupac kupi Proizvod putem Internetske trgovine, Prodavatelj \u0107e poslati Kupcu pisanu potvrdu o izvr\u0161enoj transakciji. Potvrda mora biti izdana na papiru ili na trajnom mediju poput poruke e-po\u0161te ili poruke na osobnom ra\u010dunu na Internetskim stranicama Prodavatelja, pod uvjetom da je u obliku koji Kupac mo\u017ee spremiti i koji Prodavatelj ne mo\u017ee izmijeniti bez pristanka Kupca.<\/p>

IX\/ DOSTAVA PROIZVODA<\/b><\/p>

Prodavatelj se obvezuje kupljeni Proizvod dostaviti na adresu Kupca navedenu prilikom registracije ili narud\u017ebe.<\/p>

Prodavatelj nudi dostavu Proizvoda isklju\u010divo na podru\u010dju Italije (izuzev otoka), Njema\u010dke, Austrije, Belgije, Danske, Luksemburga, Nizozemske, \u0160vicarske, Francuske, \u0160panjolske, Hrvatske, Poljske, \u010ce\u0161ke Republike, Slovenije, Ma\u0111arske, Rumunjske te Bosne i Hercegovine. Za dostave u ostale dr\u017eave \u010dlanice Europske Unije te ostale dr\u017eave svijeta morate kontaktirati Prodavatelja.<\/p>

Prodavatelj zadr\u017eava pravo odabrati ugovornu kurirsku slu\u017ebu ili uslugu po\u0161te temeljem vlastite prosudbe. Rizik o\u0161te\u0107enja Proizvoda ili njene propasti prelazi na Kupca u trenutku uru\u010denja po\u0161iljke Kupcu.<\/p>

Rok isporuke Proizvoda iznosi 40-45 dana od dana primitka narud\u017ebe u roku i na na\u010din kako je to navedeno u ovim Op\u0107im uvjetima.<\/p>

Naprijed navedeni rokovi isporuke ne odnose se na mjesta koja ne podr\u017eavaju svakodnevnu dostavu.<\/p>

U slu\u010daju nemogu\u0107nosti dostave naru\u010denog Proizvoda ili pomicanja roka isporuke, Prodavatelj u najkra\u0107em mogu\u0107em roku obavje\u0161tava Kupca putem elektroni\u010dke po\u0161te ili telefonski o nastalim problemima te se dogovara novi rok isporuke ili se vra\u0107a upla\u0107eni iznos u cijelosti. Svaku po\u0161iljku Kupac ovjerava te potpisuje primitak po\u0161iljke. Potpisom primitka od strane Kupca smatra se da je po\u0161iljka uru\u010dena slijedom \u010dega je Prodavatelj oslobo\u0111en bilo kakve naknadne odgovornosti u svezi istog.<\/p>

X\/ TRO\u0160KOVI DOSTAVE<\/b>
Kupac \u0107e o tro\u0161ku dostave biti obavije\u0161ten prilikom naru\u010divanja svakog pojedinog Proizvoda, odnosno o ukupnim tro\u0161kovima dostave u slu\u010daju naru\u010divanja vi\u0161e Proizvoda.<\/p>

Tro\u0161kovi dostave su besplatni za sve narud\u017ebe iznad EUR 2.000,00, kao i za akcijske Proizvode s nazna\u010denom besplatnom dostavom. Tro\u0161kovi dostave za narud\u017ebe ispod EUR 2.000,00 moraju biti dogovorene s Prodavateljem.<\/p>

U slu\u010daju nemogu\u0107nosti uredne dostave Proizvoda na adresu Kupca koju je isti nazna\u010dio, Kupac snosi tro\u0161kove ponovne dostave.<\/p>

Prodavatelj nema nikakvih dodatnih tro\u0161kova sredstava daljinske komunikacije.<\/p>

XI\/ RA\u010cUN<\/b>
Nakon dostave kupljenih Proizvoda, Prodavatelj Kupcu \u0161alje ra\u010dun u pdf formatu, na adresu e-po\u0161te Kupca. Kupac pristankom na ove Op\u0107e uvjete, daje svoju izri\u010ditu suglasnost da mu se ra\u010dun ispostavi u elektroni\u010dkom obliku.<\/p>

Kupac ima pravo podno\u0161enja prigovora na ra\u010dun putem e-maila customercare@woodandwise.com<\/a> Prodavatelja. Prodavatelj je du\u017ean u pisanom obliku elektroni\u010dkom po\u0161tom odgovoriti na prigovor Kupca u roku od 15 dana od dana zaprimanja istog.<\/p>

Prodavatelj \u010duva elektroni\u010dku kopiju ra\u010duna u svojoj bazi podataka za vrijeme koliko je to propisano va\u017ee\u0107im propisima.<\/p>

XII\/ PRAVO KUPCA NA JEDNOSTRANI RASKID UGOVORA<\/b><\/p>

Kupac ima pravo u roku od 14 dana od dana preuzimanja Proizvoda jednostrano raskinuti ugovor o kupoprodaji, bez potrebe navo\u0111enja razloga svoje odluke i bez kazne.<\/p>

Obavijest o raskidu te primjerak obrasca za jednostrani raskid ugovora nalaze se na mre\u017enoj stranici Prodavatelja na poveznici www.woodandwise.com.<\/p>

XIII\/ JAMSTVO<\/b>
Za Proizvod iz ponude Prodavatelja koji je ogla\u0161en na Web stranici, a uz kojeg je nazna\u010deno da postoji jamstvo za ispravnost kupljenog Proizvoda, vrijede uvjeti jamstva sadr\u017eani na jamstvenom listu odre\u0111enog Proizvoda. Jamstveni list Kupac dobiva ovjerenog uz kupljeni Proizvod u trajanju koje je ozna\u010deno na jamstvenom listu.<\/p>

Podaci o ovla\u0161tenim servisima kupljenog Proizvoda nalaze se u jamstvenom listu.<\/p>

Kada Kupac ostvaruje prava iz jamstva, a \u0161to mora biti u skladu sa jamstvenim listom, tada isti reklamaciju mo\u017ee podnijeti Prodavatelju na u ovim uvjetima nazna\u010denu e-mail adresu customercare@woodandwise.com<\/a><\/p>

Povrat Proizvoda obavlja se u skladu s uvjetima navedenim u jamstvenom listu.<\/p>

XIV\/ MATERIJALNI NEDOSTACI TE OBAVIJEST O NA\u010cINU PODNO\u0160ENJA PISANOG PRIGOVORA\u00a0 \u00a0 \u00a0 <\/strong>U slu\u010daju da Kupac smatra kako kupljeni Proizvod ima materijalnih nedostataka, odnosno ako Kupac ima primjedbe, isti mo\u017ee podnijeti pisani prigovor odnosno reklamaciju na e-mail adresu customercare@woodandwise.com<\/span><\/a> sa naznakom \u201eReklamacija\u201c te navo\u0111enjem broja narud\u017ebe, broja ra\u010duna ili svojeg korisni\u010dkog imena. Prodavatelj \u0107e bez odgode potvrditi primitak pisanog prigovora, odnosno reklamacije Kupcu.<\/p>

Prodavatelj je du\u017ean u roku od 15 dana od dana primitka reklamacije, donosno pisanog prigovora odgovoriti kupcu o osnovanosti njegova zahtjeva.<\/p>

Prilikom reklamacije pojedinog Proizvoda potrebno je prilo\u017eiti sljede\u0107e:
\u2022 Ra\u010dun Proizvoda;
\u2022 Fotografije cijelog o\u0161te\u0107enog Proizvoda;
\u2022 Fotografije detalja o\u0161te\u0107enja (iz vi\u0161e kutova);
\u2022 Fotografije serijskog broja Proizvoda (ukoliko postoji).

Prodavatelj odgovara za materijalne nedostatke na Proizvodu koje je isti imao u trenutku prijelaza rizika na Kupca.<\/p>

Pregled Proizvoda od strane Kupca-potro\u0161a\u010da
Kupac-potro\u0161a\u010d je obvezan obavijestiti Prodavatelja o postojanju vidljivih nedostataka na Proizvodu u roku od dva mjeseca od dana kad je otkrio nedostatak, a najkasnije u roku od dvije godine od prijelaza rizika na Kupca te mu omogu\u0107iti pregled Proizvoda. U slu\u010daju skrivenog nedostatka Kupac je du\u017ean, pod prijetnjom gubitka prava, o tom nedostatku obavijestiti Prodavatelja u roku od dva mjeseca ra\u010dunaju\u0107i od dana kad je nedostatak otkrio. Svakako Prodavatelj ne odgovara za nedostatke koji se poka\u017eu nakon proteka dvije godine od predaje Proizvoda.<\/p>

Pregled Proizvoda od strane Kupca-pravna osoba<\/p>

Kupac je du\u017ean primljenu stvar na uobi\u010dajeni na\u010din pregledati ili je dati na pregled, \u010dim je to prema redovitom tijeku stvari mogu\u0107e, i o vidljivim nedostacima obavijestiti prodavatelja u roku od osam dana, a kod trgova\u010dkog ugovora bez odga\u0111anja, ina\u010de gubi pravo koje mu po toj osnovi pripada.<\/p>

Kad se nakon primitka Proizvoda od strane Kupca poka\u017ee da stvar ima neki nedostatak koji se nije mogao otkriti uobi\u010dajenim pregledom prilikom preuzimanja stvari, Kupac je du\u017ean, pod prijetnjom gubitka prava, o tom nedostatku obavijestiti Prodavatelja u roku od dva mjeseca ra\u010dunaju\u0107i od dana kad je nedostatak otkrio, a kod trgova\u010dkog ugovora \u2013 bez odga\u0111anja. Prodavatelj ne odgovara za nedostatke koji se poka\u017eu po\u0161to proteknu dvije godine od predaje stvari, a kod trgova\u010dkog ugovora \u0161est mjeseci.<\/p>

Prodavatelj ne odgovara za nedostatke na isporu\u010denom Proizvodu zbog neodgovaraju\u0107eg rukovanja od strane Kupca (fizi\u010dke ili pravne osobe) ili tre\u0107e osobe uklju\u010duju\u0107i i nedostatke nastale uslijed pogre\u0161ne ugradnje ili monta\u017ee.<\/p>

Ukoliko je zahtjev o postojanju nedostatka Kupca osnovan, Prodavatelj \u0107e Proizvod zamijeniti ili popraviti o svom tro\u0161ku najkasnije u jednakom roku u kojem je isti bio isporu\u010den. U slu\u010daju da zamjena ili popravak Proizvoda iz objektivnih razloga nije mogu\u0107 ili je povezan sa nerazmjernim tro\u0161kovima, Kupac ima pravo na sni\u017eenje cijene ili raskid Ugovora.<\/p>

U slu\u010daju da reklamacija nije utemeljena (npr. nepravilno odr\u017eavanje Proizvoda i sli\u010dno), te se prigovor Kupca odbije kao neosnovan, isti je obvezan snositi tro\u0161ak povrata Proizvoda povodom reklamacije i tro\u0161ak ponovne dostave kupljenog Proizvoda na njegovu adresu.<\/p>

Na sva pitanja koja nisu ure\u0111ena ovim Op\u0107im uvjetima primjenjuju se odredbe va\u017ee\u0107eg Zakona o obveznim odnosima te Zakona o za\u0161titi potro\u0161a\u010da.<\/p>

XV\/ ZA\u0160TITA I SIGURNOST<\/strong>
Prodavatelj koristi odgovaraju\u0107a tehnolo\u0161ka i organizacijska sredstva za za\u0161titu prijenosa i pohrane osobnih podataka i pla\u0107anja putem Internetske prodaje.<\/p>

Prodavatelj se obvezuje poduzeti sve razumne sigurnosne mjere kako bi osigurao za\u0161titu svih podataka za pla\u0107anje narud\u017ebe Kupca. Prodavatelj ne odgovara za mogu\u0107u kra\u0111u podataka, osim u slu\u010dajevima propisanim zakonom.<\/p>

Prodavatelj dobiva podatke koji se odnose na narud\u017ebu Kupca. Ukoliko Kupac ne dostavi tra\u017eene podatke, to mo\u017ee utjecati na ispravno izvr\u0161enje njegove narud\u017ebe.<\/p>

Korisnik odgovara za za\u0161titu osobnih podataka osiguravanjem adrese e-po\u0161te, korisni\u010dkog imena i lozinke te odgovaraju\u0107e softverske (antivirusne) za\u0161tite svog ra\u010dunala.<\/p>

XVII\/ RJE\u0160AVANJE SPOROVA <\/b>
Sve sporove nastale u svezi ovih op\u0107ih uvjeta ili Ugovora Prodavatelj i Kupac nastojati \u0107e rije\u0161iti mirnim putem.<\/p>

Ukoliko mirno rje\u0161avanje spora nije mogu\u0107e, odnosno ukoliko Prodavatelj ne prihvati prigovor Kupca, du\u017ean je istog obavijestiti o razlozima za odbijanje prigovora te ga savjetovati o mogu\u0107nostima daljnjeg rje\u0161avanja sporova kako slijedi iz sljede\u0107eg stavka.<\/p>

U slu\u010daju da Kupac-potro\u0161a\u010d nije zadovoljan odlukom Prodavatelja o pritu\u017ebi, isti mo\u017ee u pogledu rje\u0161avanja spora:
\u2022 posjetiti europsku platformu za internetsko rje\u0161avanje potro\u0161a\u010dkih sporova na: https:\/\/webgate.ec.europa.eu\/odr\/main\/index.cfm?event=main.home.show&lng=HR<\/a><\/span>;
\u2022 pokrenuti postupak protiv Prodavatelja bilo pred sudovima dr\u017eave \u010dlanice u kojoj Prodavatelj ima sjedi\u0161te, ili, neovisno o navedenom, pred sudovima mjesta gdje Kupac-potro\u0161a\u010d ima domicil.<\/p>

U slu\u010daju spora sa Kupcem-pravnom osobom, Kupac i Prodavatelj suglasno utvr\u0111uju kako se na ove Op\u0107e uvjete i Ugovor te tuma\u010denje istih primjenjuje pravo Republike Hrvatske te kako je za sporove stvarno nadle\u017ean sud sjedi\u0161ta Prodavatelja.<\/p>
